I have a question. I know this film was recently digitized. Do you know when and if this digital document will ever be available to view from someone’s home on the Family Search website for the general public who have a Family Search account? Please see attached screenshot and link.

When you view a catalog entry and a reel is displayed it signifies that yes it has been digitized but the contract we hold with the copyright owner restricts the viewing of that item is limited as displayed , in this case the Family History Library. We are not told the reasons behind the restriction only that it exists. This is usually driven by copyright law which in the US limits the copyright to the author or his/her representative for 75 years after death unless renewed by the copyright holder. Or maybe when the copyright holder who contributed the item may have outlined the restriction when donating the item. The contract drives everything.

The one that you posted is not the one I want to see. The one that I want to see was recently digitized. Please see both screenshots for more information. I want to see the Winfield film number 979483 and digital number for this film is 8190678. I do not understand once a film is digitized that it is not available for the public to view online from any location. Thank you.

The book that you referred me to is not the correct book. I want to know about a film that was recently digitized. I am attaching the title pages of both books. The book that you referred me to is the Winfield family book about Aunt Katy Burgess’ birthday anniversary. That is not the correct one.

The original author was Charles H. Winfield and he died in 1898. William John Coulter 1890-1975, who transcribed Charles H. Winfield’s research died 1975. He must have a copyright on the work.
My second question is how would someone view the document? Is the general public allowed to view the document at one of the Family History libraries? Thank you for your help.

As displayed in the catalog the only place we allow viewing is the Family History Library not any of the affiliates. The FHL is in Salt Lake City, Utah. The address is 35 North West Temple, SLC, UT 84150-9005 and their phone is 801-240-6996.
The catalog also lists a Worldcat link which is like the world catalog of libraries. The only listing there is the FHL.
Since the catalog also lists the format as a Manuscript is seems as the book has not been formally published and this is probably the only copy.
Not good news but Utah has the worlds best snow for skiing, and great mountains and the worlds best Family History Library so you might consider a trip.

Thank you for your help. My understanding is that the intent was to publish this as a book. It was never published. Originally it was supposed to go to National DAR headquarters. Somehow DAR never received it. I am not sure why. I am not sure how FHL obtained it. FHL decided to put it on microfilm. I am grateful that it was preserved because it is part of my family history. My 3rd great grandmother was a Winfield, and she is included in this history. I have seen some pages that I received from a distant cousin. Please see the attached letter written by William J. Coulter. He wrote the letter when he was transcribing Charles H. Winfield’s research.

There are two authors in the Winfield document. The first half is written in handwriting. That was done by Charles H. Winfield the original researcher. Charles H. Winfield died in 1898. Charles H Winfield’s handwritten portion of that document is no longer protected by copyright.
The second part of the document was transcribed by William J. Coulter, which is typewritten. He died in 1975. His typewritten transcription is still protected by copyright.
I mentioned this to my husband who is an intellectual property attorney. My husband pointed out that Charles H Winfield’s handwritten portion of that document should be in the public domain, and we should be able to view it on the website.
I am attaching two pages from the document. One is Charles H. Winfield’s handwritten page, and the other one is William J. Coulter’s typewritten page.

From the catalog we can see that this is a "manuscript" and is not separated in parts. The document is treated as a whole entity. The document has been digitized therefore stored as a digital document in perpetuity. A contract was created when the document was donated to the Family History Library and that is what we have to live with no matter what the copyright issue is. It is available to view at the FHL. Come and visit that amazing facility.

I live in NYC. Perhaps someday I will visit Utah. I know that it is absolutely beautiful.
