I Robert Gibboney of Wythe County Virginia think proper to make this my last Will and Testament in manner following to__I give and bequeath to My Wife Elizabeth _Gibbioney and children my real and personal estate. I give to my wife the control of all my estate real and personal estate to manage and control as she may think best for herself and children. __my children all educated and when they arrive at the age of thirty one or Mary(marry)she may give them out of the estate what amount she may think __ taking care that one doze (does) not receive more than the other. My wife may sell my real estate and put the money out of interest for the use of herself and children, (or may use the money to support herself and children, I __ my wife Elizabeth _ Gibboney to be the executor of this my last Will and Testament. She is allowed by the court to __ no Executrix without giving bond of security. ___. ___. Is not to be appraised __ of my estate __ __ personal and no inventory of the debts __ __ giving to my wife Elizebeth _ Gibboney ___ ___ of my Estate real and personal. Virginia: At a Circuit Court held for Wythe County at the courthouse on Tuesday the 7th day of May 1867.
This the last Will & Testament of Robert Gibboney Dec'd was presented in court by Elizabeth G Gibboney the Executrix therein named & there being no subscribing witnesses; William Gibboney and John W Johnson were sworn and severally deposed that they are well acquainted with the testators handwriting and verily believe the said writing and the name thereto subscribed to be wholly written by the testators own hand. Thereupon the said writing is ordered to be recorded as the true last will and testament of the said Robert Gibboney Dec'd and on the motion of the Executrix without giving bond and security as directed in said writing or will & thereupon she took the several oathes prescribed by law & thereupon certificate is granted her for obtaining letters of administration of the said Decedents Estates with the will annexed in due form of law.
